OPEN LETTER<\/strong><\/p>\n

Bucharest, 10 of February 2014. Parents of children with disabilities in Romania, legal representatives and guardians, friends, sympathizers as Romanian citizens with equal rights and obligations, non-governmental organizations and associative groups express their profound worry for the way the situation of children with disabilities in Romania was\u00a0 presented in the official answer of the government to the inquiry made by the Office of the High Commissioner for Human Rights (OHCHR)\u00a0 regarding the access to education for disabled persons.<\/p>\n

We consider the information included in the official report to be inconsistent\u00a0with the reality. The right to freely access education of the children with disabilities in Romania is constantly overstepped, cases of abuse and discrimination being a current reality still. We believe that the official presentation from a positive perspective of statistical data is an affront and disservice to the dignity of 72.117 children and to their parents.<\/p>\n

More so, we regard the manner in which the responsible authorities understood to formulate the Romanian contribution to the “Themed UN study regarding the right to education for disabled children”[i]<\/strong><\/a>, <\/em>with no transparency during the drafting process, demonstrates the negation by the Romanian Government of a fundamental right of the disabled persons, that of being included, consulted and implicated under equal conditions<\/em>\u00a0to the decision making process.<\/p>\n

Through the submitted answer, the Romanian Government showed that it didn’t assimilate the most basic claim of the Convention of the Rights of Persons with Disabilities (article 24 – The right to education), nor the request on behalf of OHCHR: all persons with disabilities should be granted the right to education, not only children.<\/p>\n

Taking all these into account we ask for a public statement and action of the Romanian Government regarding the following:\u00a0<\/strong><\/p>\n

1. The publication of the list of attributions for each institution involved in drafting the official answer, a clear explanation of the method of data collection and a list of the consulted\/interviewed actors\/public stakeholders,\u00a0<\/span><\/p>\n

2. Organize a public debate to examine the official report and the Thematic Study,\u00a0<\/span><\/p>\n

3. Revision of the Romanian contribution to the Thematic Study and the official notification of OHCHR according to the results of the public debate.\u00a0<\/span><\/p>\n

We recommend the Romanian Government to take into consideration that the right to education (art. 24) can only be read in conjunctions with the right to an independent life and social inclusion (art. 19), <\/em>the requirement for an inclusive educational system being the premise for full inclusion and participation into the community life<\/strong>.\u00a0<\/em><\/p>\n

As follow up to our action, The European Centre for the Rights of Disabled Children and The Centre for Legal Resources will submit to OHCHR an official letter, documented through social research, presenting the actual situation of access to education for persons with disabilities in Romania.<\/p>\n
