When Parliament’s “prudery” trumps the best interests of the child

The Romanian Parliament considers that sex education in schools is not appropriate at all, and that its conversion into health education programmes should be done with the written consent of parents or legal representatives and only from the 8th grade onwards.

Paradoxically, the same prudish Parliament makes no effort to legislate the age at which a child cannot give valid consent for sexual intercourse. So let us not be surprised at the judicial practice of turning rape into a sexual act with a minor (i.e. with the minor’s consent) in cases involving children aged 6, 8, 10, 12, who of course, in Parliament’s view, do not need sex education. In short, we presume that a child should only have access to sex education after the age of 14 (from 8th grade onwards) because then they are emotionally and intellectually ready to understand it, whereas we accept in the prosecutors’ offices and courts that minors under 14 can give valid consent.

This major hypocrisy of the Romanian legislator leaves a multitude of children in unimaginable trauma for the sake of adult puritanism, leaving aside altogether any notion of the ‘best interests of the child’.
