Vino între 23 – 27 noiembrie la British Council București, Calea Dorobanţilor nr. 14, unde, în cadrul Diversity Week, poți vedea expoziția foto „Fotografii din lagăre”, parte din campania „Lagărele de lângă tine”, care promovează drepturile persoanelor cu dizabilități mintale instituționalizate. DESPRE:

▬ În perioada 2014-2015, foto-documentariștii Odeta Catană și Dan Ava au însoțit echipele Centrului de Resurse Juridice în vizitele lor neanunțate de monitorizare a respectării drepturilor omului în instituții pentru persoane cu dizabilități mintale. Astfel au reușit să surprindă în imagini fragmente din viețile unor oameni pe care nu-i vedem și la care rareori ne gândim că există.

La fotografiile profesioniste ale celor doi se adaugă o serie de fotografii făcute cu aparate de unică folosință de către rezidenții unora dintre centrele vizitate. Am strâns toate aceste imagini într-o instalație foto asemenea unei cuști, concept realizat de arhitecții de la SYAA.

„Văzusem câteva fotografii înainte, auzisem poveşti de la ceilalţi psihologi sau jurişti care fuseseră în centre, dar mă aşteptam să fiu mai tare, mai detaşată, mai „antropolog” care observă obiectiv. Greu de spus ceea ce m-a marcat mai mult, dar ceea ce îmi vine în minte, dacă închid acum ochii, este sentimentul de închis şi de îngrădire. Simţeam că şi eu, dacă voi sta mult acolo, cumva nu o să mai pot ieşi.” – Odeta Catană, fotograf

 

CONTEXT:

▬ 25.000 de copii și adulți cu dizabilități mintale trăiesc în instituții de îngrijire socială și medicală specializate, ce se încadrează în definiția internațională a instituțiilor privative de libertate. Deși rolul instituțiilor este să se îngrijească de reabilitarea, recuperarea și integrarea acestor persoane în comunitate, în realitate lucrurile se petrec exact pe dos. În spatele ușilor închise ale unor instituții opace se petrec abuzuri greu de imaginat. Despre unele aflăm periodic din presă – copii legați, abuzați fizic și verbal, fete traficate, obligate să practice cerșetoria și prostituția etc. – despre altele, ceva mai subtile, aflăm din rapoartele ONG-urilor, precum Centrul de Resurse Juridice, sau ale diferitelor organisme internaționale care supraveghează respectarea drepturilor omului în România, abuzuri precum lipsa sau calitatea inadecvată, după caz, a serviciilor medicale, psihologice, educaționale și de integrare în societate sau lipsa accesului la justiție pentru persoanele cu dizabilități instituționalizate.

Mai mult, 1.500 de persoane cu dizabilități mintale aflate în „grija” statului au decedat între 2011-2014, conform datelor furnizate de autoritățile locale din doar 27 de județe care au răspuns solicitării de informații. De altfel, un studiu al IPP din 2013 spune că două din trei persoane instituționalizate părăsesc sistemul atunci când mor. Decesele rămân adesea neinvestigate, contrar prevederilor legale. ▬ Pe 9 decembrie 2014, Centrul de Resurse Juridice a propus un proiect de lege fundamentat pe Convenția ONU pentru drepturile persoanelor cu dizabilități, care prevede înființarea Mecanismului Independent de Monitorizare a respectării drepturilor omului în instituțiile de acest gen. Implementarea Mecanismului este obligatorie, conform Convenției pe care România a ratificat-o acum mai bine de 4 ani. Proiectul de lege a trecut tacit de Camera Deputaților și urmează ca în această iarnă să-și primească votul decisiv în plenul Senatului.

Centrul de Resurse Juridice este o organizaţie neguvernamentală de apărare şi promovare a drepturilor omului. În domeniul drepturilor persoanelor cu dizabilități, CRJ împreună cu colaboratorii săi desfășoară încă din 2003 vizite de monitorizare neanunţate în centrele de plasament pentru copii cu dizabilităţi mintale, în centrele de recuperare şi reabilitare pentru persoane cu dizabilităţi mintale şi în spitalele de psihiatrie. După fiecare vizită, experții CRJ întocmesc rapoarte de monitorizare pe care le trimit autorităţilor competente și pe care le publică apoi împreună cu răspunsurile primite pe site-ul CRJ. ▬ Between 2014-2015, photographers Odeta Catană and Dan Ava joined the Centre for Legal Resources (CLR) teams during their unannounced visits aimed at monitoring if the rights of persons with mental disabilities are respected in specialized care institutions. Thus they managed to capture in powerful images slices from the lives of those people we never see out on the streets or anywhere around us and whose existence the great majority rarely thinks about.

Besides the two photographers’ professional photos, there are also a dozen taken with one-use cameras by persons with mental disabilities living in these institutions. We collected all of them and turned them into an photo installation resembling a cage, a concept designed by architects from SYAA.

“I had seen a phew photos before, I had heard stories from other psychologists or lawyers that had been to these places, but I expected to be stronger, more detached, and be more the “anthropologist” that observes objectively. It’s hard to say what touched me the most, but what comes to mind if I close my eyes is the feeling of isolation, confinement. I was feeling that if I would stay there a little longer, somehow I will never go out again.” – Odeta Catană, photographer

 

CONTEXT:

▬ 25.000 children and adults with mental disabilities live in specialized social and medical care institutions, falling under the international legal definition of being ‘deprived of liberty’. Although the role of these institutions is to make sure that these persons are recovering, rehabilitating themselves and can eventually live independently in the community, in reality they do exactly the opposite. Behind the closed doors of opaque institutions, abuses that are hard to imagine take place. About some of them we find out periodically from the media – like tied up children, physical and verbal abuse, girls who are trafficked or compelled to practice beggary or prostitution etc. – while other more subtle abuses are revealed by different reports drafted by NGOs like CLR or by other international bodies who watch over the respect of human rights in Romania – like the lack of or the inadequate quality, by case, of medical, psychological and educational services or the lack of access to justice for institutionalized persons with mental disabilities.

Moreover, 1.500 persons with mental disabilities placed under the state’s social care system have deceased between 2011-2014, according to the data provided by local authorities from only 27 Romanian counties that responded to CLR’s request for information. Actually, a study from 2013 conducted by the Institute for Public Policies (IPP) reveals that two thirds of the institutionalized persons with mental disabilities leave the system when they die. The deaths often remain uninvestigated, contrary to the law. (see here the “Map of Deaths”: https://goo.gl/VRXzFQ)

▬ On December 9, 2014, CLR has proposed a law project based on the UN Convention on the rights of persons with disabilities establising the Independent Monitoring Mechanism that should work to prevent human rights violations in institutions for persons with mental disabilities. Implementing this Mechanism is compulsory according to the Convention that was ratified by Romania more than 4 years ago. The law project passed silently through the Deputies Chamber and the Senate’s decisive vote will follow soon this winter.
